Resettle -rejected reinstallation plea rejected

The High Court of Peshawar (PHC) rejected a petition tabled by the chief of the ANP, Aimal Wali Khan, requesting the formation of a high fact finding committee and a judicial commission to explore the repercussions of the PTI government policy to reintegrate TTP agents in Khyber Pakhtunkhwa (KP).

In his petition, Senator Aimal had argued that he had been injured by the resettlement of TTP members, an organization prohibited, after the release of the international forces of Afghanistan in 2021.

He said that the KP in general and the leadership of his party in particular brought the weight of terrorist activities carried out by the TTP and yet the PTI government in 2022 allowed the resettlement of the province’s terrorists as a “goodwill gesture”.

In its order, the court has admitted that in recent decades, the KP has suffered a lot from the threat of terrorism.

“Thousands of members of the police of the police as well as civilians adopted martyrdom in the war of terrorism, in addition to the loss of the economy in billions of dollars. Terrorism and terrorists have seriously damaged the reputation of this country [as well as] the people of this province.

“Many renowned political leaders have been targeted in suicide attacks. It would not be out of context to mention that in a recent past, there was not a day which has passed without explosion of suicide.”

The court noted that the petitioner had requested the formation of a high -level commission to reveal the reasons for the resettlement of the members of the prohibited group.

“However, the available file suggests that he has not annexed any document which could be obliged to violate his fundamental rights which are guaranteed to him under the Constitution.”

The ordinance said that the framing of various policies and strategies, then pursuing or applying them is the function of the government and no individual can claim because of its inclusion in the process of policies.

“Without a doubt, sometimes the government consults individuals [experts] On fiscal and administrative issues to seek their suggestions, but so far, a decision to start a peace process and discussions with a person on a complex and sensitive problem is not enough to say that neither such a process can be put into discussion with an individual or a group of individuals nor him or the group can be taken with confidence neither associated with him. “”

He said that the Constitution is based on the basic principle of the separation of powers, adding that there are mainly three state pillars with separate powers.

“Each [pillar] of the state has the power to act in its own sphere of activity. The legislature is to make laws. The executive must put the policies submitted to the law, implement them and manage the administration.
