AJK SC cancels the ex-PM tanveer Ilyas disqualification

Mirpur:

The Supreme Court of Azad Jammu Cashmire (AJK) canceled the disqualification of former Prime Minister Sardar Tanveer Ilyas on Wednesday, allowing him to contest the elections to any public service.

The court accepted Ilyas’ appeal against his disqualification, which was granted by the High Court of the AJK in a case of contempt in the court.

Ilyas had asked for forgiveness from the Court and was repaired after a complete bench of the Supreme Court led by chief judge Raja Saeed Akram Khan ended the penalty. The verdict makes Ilyas eligible to participate in the elections after a month.

In April 2023, a complete bench of the courtyard of the High Court of Azad Jammu-et-Cachemire disqualified the Prime Minister to be elected or to be a member of the Legislative Assembly or to occupy a public charge for two years After having retained it guilty of outrage.

The unanimous decision of the six judges, written by judge Khalid Rasheed, had left everyone present at the Court at that time, because most expected the court showed the leniency and would accept the unconditional apology presented by the first Minister of AJK.

“Mr. Tanveer Ilyas admitted the content of the press clippings to the open court. Prima facie, in his declaration, a despised formulation was used which is against the prestige and independence of [the] Judicial … He submitted his response, declaring that if the prestige and the status of the judiciary are injured, he attributes unconditional apology and puts himself at the mercy of the court, “said the judgment.

While the contemporary admitted remarks concerning contempt and also refrained from submitting “any other objection or response” in response to “the surety spectacle issued to the open court”, therefore “it can be judged in complete safety that Sadite Act intervenes inside the field of contempt in the court under article 45 of the AJK interim constitution, 1974, “added the judgment.
