Rawalpindi:

The Family of the retired air marshal Javed Saeed, who was arrested in his residence last year, challenged his arrest on Thursday before the High Court of Islamabad (IHC), asking for their recovery safely.

The petition was deposited under article 199 of the Pakistan Constitution by his wife, Shazia Javed, with the Federal Government and Pakistan Air Force (PAF) named respondent.

According to the petitioner, the illegal and forced detention of her husband by the respondents, violates the fundamental rights guaranteed under the Constitution of Pakistan and against the United Nations International Human Rights, of which Pakistan is also a signatory.

The petition was deposited by the lawyer Inam-Ur-Rehman, who pleaded that the retired air marshal Javed Saeed reached the age of the retirement pension on March 18, 2021 after having reached one of the highest ranks of the PAF and serving force with distinction.

He would have been removed from his home in the E-9 sector, Islamabad, on January 1, 2024, by government staff. Police and PAF officials were contacted and, after a few weeks, the petitioner (his wife) was authorized to meet her husband.

During the meeting, an intelligence agent was present and it was revealed that the PAF had held him and that the investigation was almost finished, with his expected release in a few days.

The petitioner did her best to approach the PAF authorities for the release of her husband, but in vain, instead of releaseing her husband, her regular retirement pension was also arrested without any legal justification.

Adding the insult to the injury, the petitioner’s medical law as a wife of a retired PAF officer was also illegally canceled without any reason. Later, during the petitioner’s protest, she was only authorized for medical treatment in the PAF E-9 Islamabad hospital.

That more than a year has passed since the petitioner husband is in the illegal custody of the PAF authorities without regular procedure. The efforts to contact PAF senior officers and organize meetings failed.

The retired officer’s pension was arrested and the family health services provided by the government were also interrupted, although his wife’s medical treatment was restored. Despite this, the illegal detention of the Aerial Marshal Javed Saeed continues.

According to the petitioner, if there is an accusation opposite the agent, the same can be processed before the competent court of jurisdiction in accordance with the law.
