Sean Diddy Combs has filed a new appeal in court for his immediate release with a new argument against his allegedly unfair trial.
The disgraced music mogul, 56, made his argument through his legal team, Alexandra Shapiro and Nicole Westmoreland, in New York on Thursday, April 9.
They claimed the Bad Boy Records founder should be released under the First Amendment, according to details obtained by Page six.
Shapiro and Westmoreland argued that Diddy was wrongly convicted under the Mann Act when he was involved in the creation of independent adult strips, which is legal under U.S. free speech laws.
THE Last night The rapper’s legal team claimed that Judge Arun Subramanian, handling the case, used false allegations against Combs to harshly sentence him.
“We’ve made it very clear. The district court should not consider the acquitted conduct,” Shapiro said, adding that Combs’ sentence is “the highest sentence ever given to a Mann Act defendant with the same level of defense.”
Lawyers demanded the music mogul’s immediate acquittal and release or at least his freedom and a lesser sentence.
However, Assistant U.S. Attorney Christy Slavik called the entire argument “meritless,” marking the distinction between Diddy and adult filmmakers.
He also reaffirmed Justice Subramanian’s “properly applied” ruling given the “aggravated manner in which [Combs] committed his violations of the Mann Act.
Combs was convicted of transportation for the purpose of prostitution in July 2025 after his arrest in September 2024.
