“Even CJ Isa couldn’t prove the money trail”

ISLAMABAD:

Justice Mohsin Akhtar Kayani, a Puisne Judge of the Capital High Court, noted that it is very difficult to prove the trace of a person’s money, with former Chief Justice of Pakistan Qazi Faez Isa also having “failed” to do so.

Justice Kayani made the remark on Monday while hearing an application filed by Dr Tashfeen Khan against a summons notice issued by the National Accountability Bureau (NAB) over allegations of money laundering.

During the hearing, the petitioner’s lawyer claimed that his client had transferred his money abroad through legal channels and that he could prove the financial trace of this transaction.

The judge indicated that he would accept the applicant’s request if he proved the financial trail.

“It is really difficult to prove his financial traces. Even Justice Qazi Faez Isa could not prove his financial traces,” the judge added, while adjourning the case to January 30.

In 2019, the PTI-led government filed a case against Justice Isa, who was then a senior SC judge, accusing him of misconduct. The reference contended that Justice Isa failed to mention the foreign assets of his family members in his asset declaration.

On June 19, 2020, a full panel of ten Supreme Court justices overturned the presidential referral.

A financial trail refers to the sequence of transactions or movements of money, often used to track financial activities and determine the origin, flow and final destination of funds. This involves documenting how money changes hands or is transferred through various accounts, entities or individuals.
