Karachi:
Former judge Ahmed Ali Gabol filed a constitutional request to obtain the dismissal of the Governor of Sindh, Kamran Khan Tessori. The petitioner asked for the immediate rejection of Governor Tessori, arguing that he had violated the constitutional oath of impartiality.
According to the petition, the governor promoted politics on an ethnic basis and, while being with MQM leadership, spoke of ethnic and provincial divisions. He also declared that the governor had delivered speeches at the governor’s house and to other places, in which he would have suggested separating Karachi from the Sindh.
The petition maintains that Governor Tessori tried to encourage linguistic hatred by invoking the Ourdou language community. Such conduct, he supports, violates articles 4, 2, 25 and 32 of the Constitution of Pakistan, which guarantees equality and provincial harmony. The petitioner also cited the decisions of the Supreme Court which prohibit the use of state offices for the political agenda.
The petition argues that, under article 101, paragraph 3, of the Constitution, the president of Pakistan should withdraw Governor Tessori from the office. He maintains that the governor is a non -political position, but Tessori uses both his position and Governor House for the interests of a specific political party.
The petition requires that the office of the Governor of Sindh be supported as a symbol of federal unity and provincial harmony. The Secretary of Law and Justice of the Federation, the Cabinet Division of the secretary and the main secretary of the Governor of the Sindh were responded in the case.
