Five judges from the High Court of Islamabad (CIH) filed an intra-cout appeal before the Supreme Court, contesting the decision on legal transfers and seniority, which was tried in favor of the IHC by the Supreme Court earlier, News reported.
Through a principal lawyer to Malik, the five judges requested SC to cancel the decision taken by a bench of five members, who had confirmed the transfer of judges within the ICC.
This decision had also referred the question of judicial seniority to the president of Pakistan.
They also asked SC to restrict three transfer judges, in particular the Sarfraz Dogar judge, to fulfill legal and administrative functions as the IHC judges.
In their petition, the judges asked for an immediate suspension of the decision of June 19 of SC until their intra-short appeal was heard.
In addition, they pushed the court to impose an order for suspending the determination of the seniority of the judges transferred to the IHC, with the exception of the president of Pakistan to make decisions in this regard.
The petition also calls for the judgment of the decision of the judicial committee to appoint the Sarfraz Dogar judge as a permanent chief of the High Court of Islamabad.
The Intra-Cour Call, as well as the request for suspension order, were filed before the Supreme Court after the IHC found the transfer of judges and the question of seniority.
The legal battle between the two judicial bodies has raised concerns concerning the process of judicial appointments and determination of seniority in the highest lessons in Pakistan.
