Islamabad:
On Wednesday, the High Court of Islamabad (IHC) ordered a citizen to take her daughter to Poland to meet her mother, in a case involving a caregiver.
Judge Mohsin Akhtar Kayani made the order while hearing a petition deposited by the Polish mother of the girl, Anna Monica, who requests childcare and visit for her daughter.
The court also requested files concerning previous attempts to facilitate online meetings between the child and his mother, noting that such contact had been refused.
The petitioner’s lawyer told court that despite repeated efforts, the father had not organized any virtual meeting via WhatsApp or other platforms. In response, the father’s lawyer argued that a first instance court had already rejected the mother’s advocacy and that the father had been limited to travel because of his inclusion on the non-theft list.
Judge Kayani, however, clearly said that the child should be authorized to meet his mother and underlined the court’s intention to treat the case impartially.
He observed that children are the real victims of parental disputes and have reiterated that the court cannot resolve personal issues between spouses, only ensures that the rights of the child are protected.
The judge noted that if the girl spent time with her mother, she would end up adapting to the situation.
He ordered the Federal Investigation Agency (FIA) not to hinder the father’s trips to Poland and stressed that even if the father is free to go everywhere he wishes, he must not mislead the court.
The hearing was adjourned until September.
