The High Court of Islamabad (IHC) asked on Thursday precedents precedents, where details on the martial procedure of the Court were granted to the Court.
IHC judge Khadim Hussain Soomro, heard the plea for the production of the details of the accusation against the former Pakistani Air Force officer (PAF) Air Marshal (RETD) Jawad Saeed, who had received a 14 -year prison sentence by a military court for having disclosed sensitive information.
The lawyer for the petitioner Abdul Waheed Advocate, in addition to the additional prosecutor and legal officials of the PAF appeared on Thursday in court. During the hearing, PAF officials did not present the Martial Court procedure file and the accusation against Jawad Saeed.
PAF officials told court that, according to the PAF Act, the penalty of the sentence given and the accusation file could not be provided. The petitioner’s lawyer said it had never happened before by his own law. However, PAF officials denied this complaint.
The petitioner’s lawyer pleaded in court that injustice had been a committee in the case against Jawad Saeed, adding that neither he had been given the lawyer of his choice or the file. He said Jawad Saeed’s family was not informed either.
Judge Soomro told the petitioner’s lawyer to present precedents at the next hearing during which the file was provided in such a case. The lawyer replied that he would present the decisions of the Supreme Court and the previous legal, adding that complete bench judgments were available in similar cases.
Judge Soomro asked the lawyer to present the precedents of the court in the form of Para comments and postponed more hearing the case until June 17.
