The Islamabad High Court (IHC) on Wednesday reserved its decision on the admissibility of an intra-judicial appeal (ICA) against the single bench’s decision to dismiss the petition seeking suspension of Justice Nasir Javed Rana.
It is worth mentioning here that Justice Rana delivered his verdict in the NAB case worth 190 million pounds.
The court noted that it would pass an order on the petition after hearing the arguments of the petitioner’s counsel.
A division bench comprising Justice Khadim Hussain Soomro and Justice Muhammad Asif heard the ICA against the single bench’s decision which dismissed Justice Rana’s stay of sessions petition.
Osama Hanif’s lawyer Riaz Hanif Rahi appeared in court and argued that there was a petition against the judge and there was an order from the Supreme Court.
He read out the Supreme Court’s decision and said that notification of Justice Rana’s appointment was within the jurisdiction of the IHC. The judge was appointed here for three years, but he is still serving there, he said.
Justice Khadim Hussain Soomro asked whether a writ petition could be filed against a magistrate. The lawyer responded that a case against Justice Tariq Jahangiri had been heard.
The court noted that the case had been remanded by the Supreme Court.

Justice Soomro asked the lawyer if he had contacted the Supreme Court, to which he replied that he had presented a “clear case” and there was no need to approach the apex court.
Justice Soomro remarked that they would issue an order on the matter.
