The Islamabad High Court (IHC) has stayed the execution of a decision ordering a private airline, Airblue, to pay around Rs 5.04 billion in compensation to the families of victims of the 2010 private airline plane crash in the federal capital.
Justice Arbab Muhammad Tahir of the IHC heard the appeal filed by the airline against the order of a district and sessions court in Islamabad.
The IHC judge, after hearing preliminary arguments, issued an order staying the airline’s motion and notified the parties, ordering them to submit their responses by April 23.
Airblue lawyer Hasan Mandviwalla argued that lower courts imposed liability beyond legal limits without finding willful misconduct.
Mandviwalla further noted that the Air Transport Act of 1934, in force at the time of the accident, imposes an even lower threshold of liability.
