Islamabad:
The Pakistan Judicial Commission (JCP) is expected to meet on Monday (today) to examine the elevation of eight judges from the High Court at the Supreme Court despite the calls of certain judges and sections of the legal community to postpone the meeting.
Barely a few days ago, four judges from the Supreme Court wrote to Chief Justice Yahya Afridi, who also heads the JCP, requesting a postponement. In addition, a member of the JCP also wrote a separate letter urging the chief judge to delay the new appointments to the Supreme Court.
The reworked JCP would meet here on Monday (today). It was extended by the 26th constitutional amendment. The JCP of 13-Memmer is led by the chief judge of Pakistan and includes four judges of the Supreme Court, as well as by parliamentarians of the Treasury and the Opposition and others.
Sources indicate that the meeting should approve the elevation of the main judges of the High Court of Islamabad (IHC), the High Court of Sindh (SHC), the High Court of Balutchistan (BHC) and the high court of Peshawar (PHC) at the Supreme Court. In addition, two SHC and PHC judges are also likely to be high.
In addition to the chief judge of the SHC, Siddiqui, according to the sources, the JCP would examine four names for an elevation at the Supreme Court. Likewise, the sources said that the elevation of the chief judge of PHC Ishtiaq Ibrahim was likely, while JCP would consider four other names for an elevation at the Supreme Court.
The sources also indicated that the CIH chief judge, Aamer Farooq, and the chief judge of the BHC, Kakar, were likely to be raised at the Supreme Court, while two high LHC judges would be taken into account. The sources said that the LHC chief judge Aalia Neelum was likely to stay before the high court.
On the other hand, the sources said, the JCP had invited names for four appointments as additional judges in the LHC. The names were invited on February 13 in the context of the February 6 meeting of the JCP, they added.
Meanwhile, lawyers were divided on the question of the elevation of judges at the Supreme Court. An article of lawyers said that the process should be postponed to the decision on the disputes of the court to the 26th constitutional amendment, and the recent transfer of three judges to the IHC.
In the Last Few Days, Four Supreme Court Judes and Five IHC Judges, Besides JCP Member Senator Ali Zafar, Wrote Separate Letters to Chief Justice Afridi to Postpone The JCP Meeting UNTIL Decisions On the Pending Appeals Against 26th Amendment and the New Seniurity List of the Judge IHC.
The Action Committee for Action of Lawyers of Pakistan (APLAC), which represented the lawyers, who opposed the 26th amendment, in a press release approved the request of the four judges who refer to the JCP meeting and delay the appointment of the new judges.
The declaration, signed by several former presidents and civil servants of Pakistan Bar Council (PBC) and the association of the bar of the Supreme Court (SCBA) and other bars, including Muneer A. Malik, Hamid Khan, Ali Ahmed Kurd, Qazi Anwar, Abid, Zuberi, has promised to defend the independence of the judiciary.
The flattened announced that lawyers from across the country would hold a trial of token at the Supreme Court on Monday (today) for having demanded the decline in the 26th amendment and a complete hearing of the court of appeal against it, without the inclusion of new people named.
“This manifestation will serve as a strong and united message of the legal fraternity that any effort to captivate the judiciary or manipulate its composition will not be tolerated, he said.” We reaffirm our unshakable resolution to defend the independence of the judiciary and the rule of law. “”
However, current CPD, SCBA and provincial bars have published a separate declaration in favor of the JCP, rejecting and strongly condemning the so-called appeal to protest aimed at sabotaging the JCP meeting.
Lawyers’ organizations regretted that certain political factions within the legal community “tried to create chaos and the division to achieve their harmful political objectives” and their questionable political agendas.
“We ensure these factions that their futile exercises carried out by political elements are required to fail and will soon become ineffective.” The joint declaration indicated.
They called for the most balanced JCP training lately, adding that they have accepted the 26th constitutional amendment and the events that followed within the framework of the Constitution. “It is the duty of each law respectful of the laws to follow this framework,” added the press release.
“We, the elected officials of the legal community, have always defended the rule of law, the independence of the judiciary, the supremacy of the institutions and the maintenance of the Constitution, according to the joint declaration.
