Islamabad:
A judge on the constitutional bench (CB) of the Supreme Court noted on Tuesday that no one could be arrested without the registration of the first information report (FIR) and the order of a magistrate.
During the hearing of intra-counters against the decision of the Supreme Court which arrested the military trial of civilians, the CB noted that the affairs against the accused involved in the violence of May 9, 2023 were reserved under the official laws on secrets (OSA), but the military received no cases.
A bench of seven members, led by Judge Aminuddin Khan, heard intra-haired calls. At the start of the hearing, judge Jamal Khan Mandokhel, member of the bench, asked the lawyer for the Ministry of Defense, Khawaja Haris, to finish his arguments in the 20 minutes.
Haris replied that he would try to conclude his arguments by the end of the day. To this, the Additional Prosecutor General (AAG) Amir Rehman said that if Haris had finished his arguments today, the Pakistan Attorney General (AGP) would present his arguments on Wednesday (today).
During the hearing, judge Mandokhel said that no arrest could be made without FIR, and no one could be detained without a magistrate. Judge Muhammad Ali Mazhar said May 9 affairs were recorded under AOS, adding that the soldiers had not recorded any FIR directly.
Judge Mandokhel pointed out that this case would have deep implications for the future. Judge Amicin Khan said that after the arguments of Khawaja Haris, the court would hear the AGP on Wednesday (today).
Haris pointed out that if the judges had not asked so many questions, he would have finished his arguments. However, Judge Musarrat Hilali, in a lighter vein, said that she would not let anyone ask questions. Judge Mandokhel added that he too refrain from asking him. The hearing is expected to continue on Wednesday (today).
