Pakistan prosecutor general, Mansoor Usman Awan, said on Monday that the government had postponed its decision provided to the International Court of Justice (ICJ) concerning the recent actions of India following Pahalgam, citing changing priorities.
“Today, we were supposed to carry out the CIJ on the actions of India, but it was canceled,” informed Awan the best court during the hearings of intra-couts contesting the condemnations of civilians by military courts.
During the hearing, the Attorney General Mansoor Usman Awan appeared in court and presented arguments on three points.
The Attorney General said Khawaja Haris, the lawyer for the Ministry of Defense, had already presented arguments on the events of May 9, and also would provide some details on the issue before the court.
He said that the second part of his arguments would address the insurance given at the hearing of the main case, while the third point would concern the right of appeal.
The Attorney General informed the Tribunal that the granting of the right of appeal to those facing military trials was a political question and that he would present submissions on the issue after having asked for instructions.
Justice Jamal Khan Mandokhail pointed out that Parliament could make the political decisions it deemed appropriate, but the objective of the Court would remain limited to this case.
The Attorney General said that he had simply presented his observations and that it was up to the court to decide to grant additional time. He also stressed that the relevant provisions of military law have existed since 1967.
Judge Muhammad Ali Mazhar asked how long the Attorney General would need for his arguments. The Attorney General replied that he would finish his arguments within 45 minutes.
The hearing was adjourned until May 5.
