SC calls into question LHC’s decision in the decision to rejection of Imran’s surety

The Supreme Court published on Tuesday an opinion on the accusation in a request filed by the founder of Pakistan Tehreek-E-insaf (PTI), Imran Khan, contesting the rejection of the High Court of Lahore (LHC) of its post-arrest deposit in eight cases linked to the incidents of May 9.

A bench of three members of the Supreme Court, led by the chief judge of Pakistan (CJP) Yahya Afridi and including judge Shafi Siddiqui and judge Mian Gul Hassan Aurangzeb heard the case.

The bench led by the CJP Afridi observed that the court would not give any final conclusion which could affect the bottom of the pending case.

The CJP Afridi asked the defense and prosecution councils to help the court to the legal issue to know if final observations can be made in a bailing liberation order.

He noted that the LHC had given a final opinion in its decision to release on bond, raising the question of whether such conclusions were authorized.

Earlier, the LHC rejected the bonding petitions deposited by the founder of PTI in eight cases linked to May 9, 2023, riots, which caused strong criticism from the party, which described the decision as a “flagrant miscarriage”.

The decision, issued by a bench of two members led by judge Shahbaz Ali Rizvi, followed the conclusion of the arguments of the pursuit and the defense.

Imran’s legal team had argued that the former Prime Minister was involved without credible evidence when he was already in detention and denied any involvement in violence.

Before the Supreme Court on Tuesday, lawyer for the Punjab government, Zulfiqar Naqvi, told the court that no notice had been awarded to them in the case, to which the CJP said that the opinion would be published today.

The demonstrations on May 9, 2023 broke out across the country after the arrest of Imran in the premises of the High Court of Islamabad (IHC), where he appeared for a hearing as part of a transplant case. Several civil and military installations were damaged during the demonstrations and the chaos that followed.

Imran, who has been imprisoned since August 2023 after several convictions, remains a central figure in Pakistani policy despite his evidence in April 2022 by a vote without confidence. Several PTI managers and workers remain incarcerated during the May 9 incidents, while others were endorsed.
