SC cancels the decision against civil trials in the military courts

On Wednesday, the Supreme Court of Pakistan restored the law of the Pakistani army in its initial form, reversing its decision of October 23, 2023 which had declared certain provisions of the unconstitutional law.

In a majority verdict 5-2, the Supreme Court confirmed the calls filed by the Ministry of Defense and others, the restoration of the clauses previously canceled, including articles 2 (1) (d) (i), 2 (1) (d) (i) and 59 (4) of the army law.

Amicin khan judges, Muhammad Ali Mazhar, Musarrat Hilali, Hasan Azhar Rizvi and Shahid Waheed supported the verdict, while judges Jamal Khan Mandokhail and Naeem Akhtar Afghan dissident of the assertion.

The majority judgment urged Parliament to make the amendments necessary for the Pakistani army law within 45 days in order to provide an independent right of appeal to the convicts of the military courts before the High Court.
