SC cancels the sentence of former chief judge Jawad S. Khawaja

The Supreme Court of the Constitutional Banc of Pakistan, led by Judge Amicin Khan, canceled the sentence imposed on former chief judge Jawad S. Khawaja.

The penalty, amounting to Rs 20,000, was previously imposed after the Khawaja petition concerning the military court affair was considered a delay tactic, Express News reported.

During the hearing of the military court case, the constitutional bench of seven members, led by Judge Aminuddin Khan, canceled the order, while judge (R) Jawad S. Khawaja, Khawaja Ahmed Hussain, presented his arguments.

Khawaja Ahmed Hussain said the country had been built through the efforts of great lawyers like Muhammad Ali Jinnah, and this constitutional bench is seated under an image of Jinnah.

He expressed his concern that the judiciary had previously made decisions that harmed the nation, and he pleaded for the calls to be rejected while maintaining the central decision. He mentioned that his client had been sentenced to a fine of 20,000 rupees and that they had tabled an examination against the order.

Khawaja Ahmed Hussain also asked the court to withdraw the ordinance imposing the fine, which Muhammad judge Ali Mazhar pointed out, suggesting that they could double the fine. However, he said it was said with humor.

Khawaja Ahmed Hussain explained that the petition had become largely ineffective since the constitutional bench had already heard the majority of the case.

After consulting his colleagues judges, Judge Aminuddin Khan informed Khawaja Ahmed Hussain that the court had decided to have the case according to the withdrawal of the exam.

The constitutional bench has now reversed the ordinance imposing the fine on the former chief judge Jawad S. Khawaja. Khawaja had filed a separate request requesting a suspension in the military legal proceedings until a decision was made during the 26th constitutional amendment.
