Islamabad:
A sister of the Baloch rights activist, Dr. Mahrang Baloch, approached the Supreme Court against an order from the High Court of Balutchistan (BHC) in the detention of his sister.
A BHC division bench on April 15, rejected Dr. Mahrang’s request against his detention under public order order (MPO), declaring that an alternative was available for the activist in the form of a representation.
The bench had also converted the petition into representation and ordered its office to present it before the competent authority constituted in order to decide on the representations under the MPO.
The petitioner, Nadia Baloch, argued that the BHC had made an error by judging that a request could only be filed in court after having exhausted the option of filing a representation.
The petition argued that the High Court in its brief court is competent to intervene and directly give a repair to a petitioner by determining the legality of an order of the MPO without the need for the detained person representing.
He said the BHC did not consider Dr. Mahrang’s right to deposit Habeas Corpus’s petition. “”[This is her] The high prerogative right and a constitutional appeal for all questions in the event of illegal containment, “said the petition.
