On Wednesday, the High Court of Islamabad (IHC) asked for the help of the Federal Board of Return (FBR) concerning its administration pool, while confirming the suspension order against the concession of the Great Power Selection Board for the promotion of FBR officers.
IHC Judge Sardar Ijaz Ishaq Khan heard a petition file from Shah Bano Ghaznavi, an FBR officer of the 21st year, against the exclusion of promoting promotion in the 22nd year. The court said that it was for the first time that an officer raised this issue and that the court would see it for its actors.
During the hearing, Afnan Karim Kundi, the FBR lawyer, said that the board of directors met after two years, but this time too, the FBR officers could not obtain the promotion. He added that senior officers, who would retire in June or July, would have been affected.
Judge Khan pointed out that it had happened on both sides and that it had already happened. He asked the lawyer to request instructions from the FBR to answer the question of the court if the decision to send Ghaznavi to the correct administration pool.
The judge said that on a clear response to the request of the court, he would cancel the suspension order at the next hearing. However, he warned that if the FBR could not satisfy the court, he would summon the president of the FBR in person to answer the question of the court.
The judge asked the lawyer to inform the court if it was legal to include FBR officers in the administration pool; If legal, then for how long an officer could be kept in the administrative swimming pool; What was the legal status of the administrative swimming pool and what was the official instructions of the FBR concerning the administration pool.
The petitioner’s lawyer declared in court that during the case, a new notification had been issued, according to which an officer could be considered for the promotion twice. However, the judge refused to consider the notification at this stage of the case.
The FBR lawyer said that in accordance with the criteria, there should be three best personal evaluation reports (PERS) during the six -year period for the promotion of any 22nd year officer. The petitioner’s lawyer said Ghaznavi had two excellent people, but she did not get promoting earlier.
The lawyer said that a false investigation had been launched against the petitioner, so she could not be envisaged for the promotion, pending an investigation. And now it had been placed in the administration pool. Judge Khan pointed out that it was an old tactic.
Judge Sardar Ijaz Ishaq Khan asked the lawyer what was going on throughout the government. If there was honesty at the top, then there would be honesty at the bottom too, but if the top was not fair, there could not be any integrity below.
The FBR lawyer said that the administration pool had a goal and that he was supposed to punish anyone. With that, the judge arrested the lawyer, saying that he gave unrelevant arguments. The lawyer said the administrative swimming pool was a stopgap agreement before the new appointment of an officer.
Judge Khan pointed out that a person could be maintained in the pool for 10, 15 or 20 days. He then asked the lawyer if the officer could be kept in the administration pool for nine months or ten months or even a period of one year. “This is a completely arbitrary power to include any officer in this swimming pool as long as you wish.”
The FBR member, Hamid Atiq, asked the court to leave the suspension order at the meeting of the board of directors, saying that he had the service for 35 years and that he retired in July. On this subject, the petitioner Ghaznavi said that she was the most sensitive officer and that Atiq was eight years junior for her.
Judge Khan pointed out that it was the first time that an officer has raised his voice and that the court would examine the question not for an individual but for future officers. The court confirmed the suspension order and postponed the case of the case until Friday (tomorrow).
