The officials said in April that the death of the son of Brett Gardner, 14, Miller, was caused by carbon monoxide, but the authorities would still have investigated to find out if it was a homicide.
The Gardner family announced Miller’s death on March 23, two days after his death. Officials judged the cause of death on April 3 after investigating food poisoning and asphyxiation.
However, according to ESPN, a spokesperson for the Costaist prosecutor’s office dealing with the case said the case was under investigation, and prosecutors still determine if the death would be tried of a homicide.

“The purpose of the investigation is precisely to determine whether or not we are dealing with a possible homicide. For this reason, it is not possible for the moment to confirm or exclude that a crime has been committed,” said the spokesperson.
Miller has been tested for carboxyhemoglobin, a compound generated when carbon monoxide binds to hemoglobin in the blood. The test showed a saturation level of 64%. It is considered fatal when the saturation of carboxyhemoglobin exceeds 50%.
The Gardner family stayed at the Arenas del Mar hotel in Manuel Antonio.
Several family members fell ill during the trip, the Garders announced.

“We have so many questions and so few answers at this stage, but we know that he died peacefully in his sleep on the morning of Friday, March 21,” said the family declaration. “Miller was a beloved son and brother and we cannot yet understand our life without his contagious smile. He loved football, baseball, golf, hunting, fishing, family and friends. He has lived life as much as possible every day.”

Gardner was a voltigger for New York Yankees for 14 seasons and was part of the team when they won their last World Series title in 2009. He spent his entire career in the Bronx, for the last time in 2021.
