The Swarthmore College responded to a legal action submitted by the transgender athletic athlete Evelyn pieces which alleges that the school deleted the parts of the female team after the NCAA modified its rules to prohibit men from participating in female sports, but then added parts to the team despite the new rules.

The documents filed the trial this week, becoming the third trans athlete in the space of a month to continue an American college for having been withdrawn from a female team.

Swarthmore provided a statement to PK Press Club Digital in response to the parts and specific allegations to add parts to the team after the NCAA has changed its rules.

“Swarthorus deeply values our members of the Transgender community and the many ways they enrich the life of the campus. We offer many resources to create a welcoming, favorable and inclusive environment for transgender people. We recognize that it is a particularly difficult and painful moment for members of the Transgender community, including student-athletes,” said the press release.

“We worked to support Evie Parts in a period of rapidly evolving advice, while balancing the capacity of other members of the female track team to participate in NCAA events. Given the current dispute, we will not comment more.”

Parts allegedly alleged that the school said that the pieces could no longer compete in the female team in February, the same month that the NCAA changed its sex eligibility policy after the president Donald Trump Signed the executive decree “keep the men of female sports”.

The units trial also claims that the Trans athlete was “fully reinstated” to the female track team of Swarthorus on April 11. The pieces claim to have been authorized to compete in the women’s team until they graduate in May, even after political changes and Trump’s decree entered into force.

Shares is listed as the winner of the 10,000 female meters at the Bill Butler Invitational in April and as a participant in the Paul Donahue invites the same month and the Centennial Championships in early May, according to the athlete Swarthmore Athletics page.

Parts lawyer, Susie Cirilli, previously provided a declaration to PK Press Club Digital sending the trial.

“We support the allegations of the complaint. As indicated in the complaint, the NCAA is a private organization that has issued a fanatic policy. Swarthmore has chosen to follow this policy and not take into account the federal law and the states,” said Cirilli.

Swarthmore would not be the first school to allow a biological man to compete in female sports after the change of NCAA rule, if the allegations are true.

The ITHACA College of New York admitted to having enabled a Trans athlete to participate in a Division III rowing competition in March. The Trans athlete contributed to the duals of Cayuga, but only in the third Varsity Eight event, which is not taken into account in NCAA Championship qualification.

Ithaca provided a statement to PK Press Club Digital saying that the participation of the Trans athlete was due to a “misunderstanding” by coach staff.

The NCAA made a statement to PK Press Club Digital discussed the violation of ITHACA’s policy.

“Policy is clear that there is no derogation available, and students assigned to birth may not compete in a female team with modified birth certificates or other forms of identity,” said NCAA.

“If the competition occurs, the team will be considered a mixed team and not eligible to compete with the women’s teams. Ithaca has declared their intention to join politics, which allows practice opportunities, and NCAA appreciates the responsiveness of Ithaca.”

The NCAA has not indicated whether the results of the event would be canceled or if ithaca would face consequences.

Former President Joe Biden had in place a decree that protected the rights of Trans athletes to participate in female sports, and the previous NCAA policy has enabled Trans athletes. The participation of the former Trans swimmer of the University of Pennsylvania, Lia Thomas, and the former Trans Volleyball player by San Jose Tram, Balaire Fleming, caused multiple prosecutions against these institutions and the NCAA, led by Riley Gaines, Brooke Slusser and several former female swimmers of Upenn.

The athlete Trans Sadie Schreiner, which CIRILLI also represents in a trial against Princeton University, was previously authorized to compete for the women’s team from Rochester Institute of Technology (RIT) for two years before the change in the February NCAA rule. The former female runner runner laughs, Caroline Hill, joined the Gaines trial against the NCAA, citing her experience in competition and sharing a cloakroom with Schreiner.

Trump’s Ministry of Education has already taken measures against several universities on trans inclusion incidents in female sports before Trump’s decree. The DOE concluded an agreement with UPENN for Thomas’ participation in swimming of women in early July. The university has agreed to erase the records of the Trans athlete and apologize to all the female athletes affected by the presence of Thomas in the women’s team.

Earlier in August, the DOE concluded an agreement with Wagner College for a similar resolution concerning the former Trans Redmond Sullivan shooter.

The DOE survey on San Jose’s state on Fleming’s controversy is underway.

PK Press Club Digital contacted the NCAA to comment on the documents.
