New IHC bench on the Aafia dissolved case

The newly constituted bench was formed to hear the case concerning the health and repatriation of the Pakistani neurosci-entry imprisoned Dr. Aafia Siddiqui were dissolved.

Judge Inaam Ameen Minhas of the High Court of Islamabad (IHC) sent the file to the chief of IHC on Monday, Sardar Muhammad Sarfraz Dogar, for the end of a wider bench.

This case had been previously transferred from the court of judge Sardar Ejaz Ishaq Khan, who had issued advice from contempt to Prime Minister Shehbaz Sharif and his members of the cabinet for having ignored his order to provide reasons for not having helped an American court hearing the case of Dr. Aafia.

On Monday, judge Minhas heard arguments concerning the health of Dr. Aafia and the return of an American prison when hearing the petition tabled by the sister of Dr Aafia, Dr Fowzia Sid-Diqui,

The petitioner’s lawyer, lawyer Imran Shafiq, told court that the case had become quite complicated. The judge said it was not the case and that his decision was clear that the chief judge was the master of the list.

“Judge Munib [Akhter] Also held [that the CJ is the mas-ter of the roster]And I gave the same decision. However, then another [judge’s] Opinion differs, I refer to this question to a wider bench. The largest bench will decide who is the master of the list. “”

Earlier, this case was heard by judge Sardar Ejaz Ishaq Khan, who, on July 21, initiated an outrage procedure against Prime Minister Shehbaz and his entire cabinet. “The responses of all ministers, including the Prime Minister, will be filed within two weeks of today,” said the order written by judge Khan.

The judge noted that in his last ordinance, he had given the government time to return with his decision, while the CAU-Transmitting the head of the law of the State, this inaction would lead to an outrage procedure.

The federal government, on July 15, approached the pre -prevenue court, seeking to cancel on May 16, 2025, or to the gold of the IHC which allowed the modifications of a petition previously regulated concerning Dr Aafia -, in the end, after its deposit.

Judge Ejaz Ishaq Khan was to go on summer vacation from July 21. However, he announced during the last hearing that he would hear the case on July 21. Interesting, the IHC did not list the case to hear before its bench.

The judge, however, heard the case and then made a granting order. He also criticized the Chief Judge of the IHC, Dogar, and the entire “demolition team catapulted” the IHC after the 26th amendment.

Dr. Aafia Siddiqui is a Pakistani and educator neuroscientist who drew international attention following his conviction in the United States.
