IHC suspends the order of Sattar on the chef PTA

The High Court of Islamabad (IHC) suspended the ordinance of judge Babar Sattar by removing the president of the Major-General (RETD) as president of the Pakistan Telecommunication Authority (PTA), the temporarily restoring at the post.

A division bench including judge Muhammad Asif and judge Inaam Ameen Minhas made the order Thursday after a first hearing on three intra-core appels filed by the PTA, the federal government and the ousted president of the PTA.

PTA lawyer, Salman Mansoor, argued that before withdrawing the president, or the rules were disputed neither a notice was rendered to the AGP, which was compulsory.

He said that reparation not requested in the petition was granted, while in virtue of article 199 of the Constitution, the court cannot decide not specifically argued.

He said the court itself noted that the arguments had not yet been completed and that two requests raising objections were also underway, but the decision was reserved without contacting them.

The lawyer also argued that when lawyers were on leave, the court reserved a judgment, then exercised Suo Motu powers to withdraw the president of the PTA.

Rehman’s lawyer Qasim Wadood argued that the petition had questioned his appointment as a member of the PTA and said that the post had been wrongly announced, while the rules had been modified with the approval of the federal cabinet before his appointment.

In support of the intra-haired appeal of the federal government, the additional prosecutor Rashid Hafez told the bench that the post had attracted 64 national candidates, 24 of whom qualified.

He said that the eligibility criteria were strictly followed and that no candidate had disputed the process. The rules, he said, have been modified with the approval of the federal office before the post advertising.

After hearing the arguments, the bench accepted the diverse request requesting the suspension of the Verdict of the single bench. He also issued an opinion to the Usama Khilji petitioner and postponed other procedures.
