Former assistant women’s volleyball coach of the San Jose State University, Melissa Batie-Smose, filed a complaint against the California State University (CSU) system. SJSU is one of the 23 schools based in California that are part of the CSU system.
The Batie-Smose contract was not renewed when he expired in February, after being suspended from the team in the middle of the season for having filed a complaint in title IX concerning the treatment by the program of a transgender athlete of his team and a player who opposed the trans athlete.
Now Batie-Smose claims the unfair dismissal, saying that it “has suffered and continues to undergo lost wages, a loss of reputation and professional opportunity, emotional distress and other damage”.
“The actions of the defendant were voluntary, intentional and / or taken with reckless contempt for the rights protected by the applicant,” said the trial.

“Other coaches who did not oppose the inclusion of a biological man in the female volleyball team or who did not argue for the rights of female athletes, were not subject to a suspension, a dismissal or any discriminatory actions, just like the applicant.”
A spokesperson for the State University of San Jose responded to the trial.
“We are aware of the deposit and we no longer have any comments due to an in progress dispute,” the spokesman for PK Press Club Digital told.
