Islamabad:
The judge of the Supreme Court, Athar Minallah, issued a dissenting note handwritten in a case linked to the initiation of an outrage procedure against the additional registrar of the SC Nazbas.
The judge was part of the largest bench of six members who addressed the intra-loss appeal of the additional registrar against a presentation notice issued by a division bench.
The petitioner had subsequently filed a request requesting the authorization to withdraw the appeal filed under article 19 of the order on the OUTCTION in the Court, 2003.
On January 27, two members of the bench – judge Shahid Waheed and judge Minallah – rejected the appeal for being withdrawn. They had noted that, as the original bench had unloaded the notice of outrage, the continuation of the call was no longer necessary or relevant.
In his note, judge Minallah concluded the opinion of judge Shahid Waheed. He noted that the disputed call had become unsuccessful since the release of the opinion.
“This bench was constituted under the order of the outrage in the court, read in 2003 with article 204 of the constitution of the Islamic Republic of Pakistan, 1973.
“There are no other outstanding work before this bench. With the discharge of the disputed opinion, there is no longer any expectation, the appeal is therefore rejected accordingly,” he added.
