Court orders arrest of ex-ISI chief Faiz Hameed’s brother after canceling bail

ISLAMABAD:

A special court on Wednesday passed a written order canceling the bail of Najaf Hameed, the brother of former Director General of Inter-Services Intelligence Lt Gen (retd) Faiz Hameed, and ordered his arrest.

The written order was issued two days after the court announced its decision. FIA Central Special Judge Shah Rukh Arjumand delivered a reserved verdict, recording a series of allegations against the accused.

According to the order, Najaf Hameed is accused of preparing a false register and fraudulently altering land records. The court said that instead of transferring one canal plot to the complainant, the accused allegedly transferred only 10 marlas by deception.

The order also contains allegations that the accused abused his official position for personal gain. He noted that an investigation under the Money Laundering Act was also underway.

The prosecution told the court that the arrest of the accused was necessary to ensure access to essential facts and to complete the investigation. She argued that extraordinary measures such as bail could not be granted simply on the basis of the complainant’s statement or a purported settlement.

Having accepted the request of the Federal Investigation Agency, the court canceled the bail and ordered that the accused be remanded in custody.

Several national media outlets reported that Najaf Hameed was not present in court when the order was announced and could not be arrested immediately.

The court noted that bail had already been granted to the accused, but held that this measure could not be sustained given the nature of the allegations and the needs of the investigation.

The prosecution argued that reliance on the complainant’s statement or a purported settlement could not negate the need for custodial interrogation, particularly in cases of abuse of official authority.
