The DPC claims to have “in discussions” with X about the “potentially harmful” images since they began circulating widely, although X has made no official comment. The social media platform has previously insisted that the necessary safeguards have been put in place, but regulators are not convinced.
Investigations and searches
This new investigation comes on top of a separate EU investigation that is looking at the same issues, but under laws that force platforms to stop the distribution of illegal material – which in this case may include child sexual abuse material. The United Kingdom, which is no longer part of the EU, has also launched its own investigation.
Searches also took place earlier this month at X’s offices in Paris by French and European law enforcement, as part of ongoing investigations that also cover AI-generated images. As the Financial Times reports, X denied any wrongdoing at the time.
At the moment, it’s unclear how long the new investigation will take, or what the outcome will be, but substantial fines are certainly on the table – if X is found to have lacked the data privacy protections it put in place around these images.
