Tyler Robinson’s lawyers raised serious questions about the connection between the bullet and the gun in a recent court filing.
Tyler Robinson is accused of shooting and killing Charlie Kirk, 31-year-old conservative and founder of Turning Point USA (TPUSA), on September 10 at Utah Valley University.
Tyler Robinson’s lawyers have asked the court to delay the next hearing which is scheduled to take place in May.
The motion was filed Friday, March 27, seeking rights under the guise of the Sixth and Eighth Amendments to the U.S. Constitution.
According to Robinson’s lawyers, the prosecution has not shared all the evidence and so the defense needs more time to prepare.
As a reminder, the alleged accused of the murder of Charlie Kirk, Tyler Robinson, is due to be heard on April 17, 2026.
Robinson’s lawyers made a surprise move in the motion that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) did not link the rifle to the bullet used to kill Charlie Kirk during an autopsy.
“With regard to the firearms evidence, the defense received a summary report from the ATF which indicated that the ATF was unable to identify the bullet recovered during the autopsy with the rifle allegedly attached to Mr. Robinson,” according to the motion submitted to the court.
The motion also stated that the FBI was “in the process” of conducting a second comparative analysis of the bullets, as well as an analysis of the pellets of the bullets.
The defense said in its motion that it might try to use the analysis to get a net score for Robinson at the preliminary hearing.
While prosecutors are determined to prove they have enough evidence against Robinson, Charlie Kirk’s alleged killer, to proceed with the trial.
Prosecutors are seeking the death penalty against Tyler Robinson, 22, charged with aggravated murder in the Sept. 10 shooting of Charlie Kirk on the campus of Utah Valley University in Orem.
