Marwat argues that the process leading to the change of CM was initiated by Imran Khan, who was found guilty and disqualified
ISLAMABAD:
Shair Afzal Marwat, who himself admitted to being elected as a member of the National Assembly on the platform of Pakistan Tehreek-e-Insaf (PTI), has approached the Federal Constitutional Court (FCC) seeking the restoration of Ali Amin Gandapur as the Chief Minister of Khyber-Pakhtunkhwa.
Marwat argued that the process leading to the change of CEO was initiated on the basis of directives issued by Imran Khan, who was found guilty and disqualified under Articles 62 and 63 of the Constitution.
In his constitutional petition filed under Article 175E, Marwat says the issue is of “profound public interest” as it involves what he describes as protecting the votes of millions of KP citizens against what he calls extra-constitutional and extra-judicial orders.
He argues that when the functioning of an entire provincial executive is influenced by external dictation, it directly undermines the fundamental rights guaranteed by sections 9, 17 and 2A, creating what he describes as an “absolute imperative” for the court to exercise its jurisdiction.
The petition further seeks that the respondents be restrained from acting or carrying out any other political or constitutional directives issued by any disqualified person or any illegal or derecognized political entity in relation to the governance of the KP.
