Convicted double murderer Mackenzie Shirilla shared a new prison selfie on social media, striking a somber pose as her legal team continues its latest efforts to persuade the Ohio Supreme Court to reconsider her appeal.
The photo, uploaded by Shirilla to her Instagram page on Tuesday, depicts the 21-year-old posing against a wall at the Ohio Reformatory for Women, her lips pursed as she looks directly at the camera. The caption for her “support team” reads: “Trying to do better every day and staying hopeful.” »
The selfie was posted hours after Shirilla’s attorney filed a motion asking the state’s highest court to reconsider its June 23 decision refusing to consider her appeal. His filing of post-conviction relief was found to be one day late than the 365 days allowed by law, an error caused by the failure to take into account the fact that 2024 is a leap year.
Shirilla was convicted of murder in 2023 when she deliberately rammed her car into a building going more than 100 mph, killing her boyfriend, Dominic Russo, 20, and his friend, Davion Flanagan, 19. She had been sentenced to 15 years to life in prison, with her first parole hearing scheduled for September 2037.
In Tuesday’s filing, attorneys John T. Martin and Steven L. Bradley argued that Ohio appellate districts apply filing deadlines inconsistently, citing cases in other districts applying filing deadlines inconsistently, citing cases in other districts where similar late petitions have been granted.
This case gained further popularity after the launch in May of the Netflix documentary, which was the most viewed film for two consecutive weeks on the streaming platform.
However, it is unclear whether the Ohio Supreme Court will respond to the latest call for reconsideration. Judge R. Patrick DeWine disagreed with the court’s previous verdict.
