Islamabad:
The High Court of Islamabad (IHC) declared article 7 of the 2015 law on the 2015 law, declaring it contradictory to the Constitution, and canceled it with all the orders taken under its provisions, Y including notifications.
Judge Arbab Muhammad Tahir published a detailed verdict on a petition contesting the amendment to the 2001 verifier general order through the finance law.
The decision said that the Constitution is the country’s supreme law and that any legislation draws its authority. If a law exceeds its powers given or contradicts a constitutional provision, it is judged beyond the legal (ultra-vires) and unconstitutional authority.
The judgment has also declared that the Parliament adopts laws within the constitutional framework and that any conflictual legislation with the Constitution or its law on parents is made ineffective.
For a law to be valid, it must be logical and clear and must not contradict the general legal principles or the Constitution.
The Court judged that the regulations could be canceled if they are promulgated in violation of legal procedures, contradict other laws or against their parents. The ambiguous, unreasonable or illogical ambiguous statutes can also be declared zero.
