Dale Jr., however, is now trying to mark the number itself, stylized in the way he was on his car. He submitted the request last December.
But Jackson argues that the Earnhardt application is in conflict with its own brands.
In an opposition notice, Jackson says that he is largely associated with n ° 8 “because of his notoriety and renown, as well as his promotion of this issue in his marks and in media coverage” and that he could be “damaged” by the registration of Earnhardt Jr.

This is not the first time that Jackson has defended his brand. He ended up in a similar battle with Troy Aikman last year, who tried to mark the word “eight”.
