IHC lifts bar on the collection of gas withdrawals

The High Court of Islamabad (IHC) has enabled the government to collect the gas from the captive power plants, but prevented it from using money until ad hoc legislation receives the approval of the Parliament, in an order which responds to the concerns of the IMF for the moment.

In its order, the court noted under its three -week stay granted against the resumption of RS791 by lifting MMBTU gas to the owners of the factories using gas to produce internal electricity.

The levy was imposed on the IMF’s instructions to force the gas industries to the national electrical network.

The government wanted to use money to reduce the prices of electricity by approximately RS1 unit in accordance with an understanding of the IMF.

The court released its reserved prescription after the AGP Mansoor Awan thanks to a request asked for a residence permit.

“By examining the above, the divided civil request is authorized, and the provisional order is recalled subject to the following express conditions”, reads the judge’s order.

The court indicated that “all the tax amounts collected from the petitioners under the contested order are deposited and kept in the federal consolidated fund for the duration of the validity of the order, that is to say 120 days from its promulgation”.

The court also judged that the money will not be assigned, transferred or spent for purposes other than those provided under the disputed order.

The order indicated that “in the event that the contested order does not receive parliamentary approval, all the sums collected under its authority must, when observing the order, be reimbursed immediately to the petitioners, without deduction or delay”.

In February, the government had promulgated a presidential order to impose an out -of -network gas levy on these internal power plants, but did not inform the rates. During the TMI talks, it became a problem and on March 7, the government informed a 23% increase in gas rates for industrial captivity power plants (CPP) by imposing an RS791 by lifting MMBTU.
