Victims of air strikes to obtain compensation

The High Provincial Court of Khyber Pakhtunkhwa (KP) accepted a petition requesting compensation for a group of people who were killed during an air strike during alleged hiding places of terrorists in the KHHYBER District of KP in 2013.

According to the petition, the fighter planes of January 31, 2013 bombed the residence of the petitioner, Ghazi Jan, in the Kuki Khel region of the former Khyber agency.

The attack led to the death of five family members, including his mother, his wife, his son and his two daughters. Jan and another person were also injured while four rooms in his house were completely destroyed.

Following the incident, a request was submitted by Madokhel Jirga to the assistant political agency of the agency Khyber who sent him to the political agent for compensation.

After an investigation, the political agent ordered compensation from RS3 lakes by deceased. The petitioner argued that RS1 lake had been paid for each injured but said that no compensation had been awarded for the destroyed house.

Not being satisfied with the amount of the compensation, the petitioner filed a brief request that the High Court of Peshawar (PHC) published on April 19, 2022, because it ordered the chief secretary of the KP to examine the question by keeping the previous judgments adopted in WP n ° 59-P / 2016 and WP no.3562-P / 2017.

As the case could not be decided as indicated by this court, the petitioner used the deposit of the petition for outrage. During the suspension of the petition for contempt, the representatives of the respondents undertook to comply with the PHC orders. The outrageous advocacy was then eliminated.

Finally, the government argued that the facts of the case of the petitioner were different from WP n ° 59-P / 2016 and WP n ° 3562-P / 2017 and, consequently, it was not allowed to receive compensation.

Feeling injured, the petitioner deposited the constitutional petition, requesting an appropriate compensation.

After hearing the arguments of both parties, judge Fazal Subhan of the PHC authorized the petition, ordering the Ministries of Defense, Safron and the Finance Division to make measures for the payment of compensation in the petitioner at the earliest at the rate of RS10,94,816 by deceased.

However, he ordered that RS3.00,000 per previously deceased either paid to the petitioner by the political authorities of the former Khyber agency is deduced from the amount.
