CB examines the state of special courts

Islamabad:

The lawyer for the Ministry of Defense informed Thursday the Constitutional Banc (CB) of the Supreme Court that the special courts were the courts which used special jurisdiction to judge criminal affairs, and said that no May 9 would have claimed not having received a fair trial.

A CB of seven members, led by Judge Aminuddin Khan, continued the hearing for intra-luds against the decision of the Supreme Court against the trial of civilians before the military courts.

The court asked the lawyer for the Ministry of Defense, Khawaja Haris, to complete his arguments by Friday.

During the hearing, judge Jamal Mandokhail pointed out that article 175 of the Constitution was the only article which described the establishment and the court of the courts.

However, Haris cited a previous decision which indicated that martial and special courts are not part of article 175.

On this subject, judge Mandokhail asked the question, whether or not the special courts could be called the courts. Khawaja Haris replied that the special courts were the courts that led criminal trials, using a special jurisdiction.
