Islamabad:
The High Court of Islamabad (IHC) ordered a Pakistani father on Tuesday to guarantee the weekly video calling video between his minor daughter and his Polish mother in a case of child care.
Judge Mohin Akhtar Kayani heard the petition filed by the Polish mother looking for the return of his daughter from Pakistan. In accordance with judicial orders, the father, Adeel Khan, appeared in court and presented the child.
After the court instructions, the four and a half year old girl, Anita Maryam Khan, was authorized to speak with her mother, Anna Monica, via a video link in a separate room. It would be their first conversation in three years, because the child was brought to Pakistan when she only had a year and a half.
The court ordered the father to facilitate weekly video calls between mother and daughter and submit a report on implementation at the next hearing. The mother was also responsible for providing an update on the progress of the parallel custody case heard before a Polish court on June 16.
During the procedure, the court asked if the child had recognized his mother. The father’s lawyer said that the daughter had recognized her mother but did not engage a lot of conversation due to the long separation. Judge Kayani stressed that, for the moment, the court could only restore contact between the child and his mother by virtual means.
Answering the questions of the court, Adeel Khan said that he had left Poland due to mother threats and that he no longer held Polish citizenship. He alleged that the mother had tried to harm him and to the child and said that he had also approached Polish courts on this subject.
The court postponed the hearing until July 9 and ordered the two parties to comply with the ordinances in the meantime.
