Relief for industries while PHC remains withdrawal

Peshawar:

The High Court of Peshawar (PHC) suspended the taxation and recovery of the debit newly introduced on all the industries generating electricity through gas generators.

A division bench including judge Syed Arshad Ali and Judge Qazi Jawad made the ban on Wednesday.

The federal government had imposed the levy by an order promulgated in January 2025, forcing all captive power producers to pay a tax determined by the federal government.

However, the cement and textile industries, being part of the producers of captive power, challenged the order in the PHC, asking the court to prevent the federal government from notifying the rate of levy.

The notification was then issued on March 7, 2025, fixing the tax to RS791 by MMBTU. An official request was moved to the suspension of the notification.
