Justice Jamal Khan Mandokhail observed that the government should send all cases before military courts for declaring after declaring that the civil system has collapsed.
Judge Mandokhail is part of a constitutional bench of seven members of the Supreme Court, who resumed on Monday hearing the intra-cost appeal filed by the government against a previous order of the Court of Apex, announcing the trial of May 9 of the rioters in the military courts.
The Pakistan Attorney General (AGP) Mansoor Awan began his arguments in support of intra-cap appeals and noted that the right to appeal to those sentenced by military courts is a political question, on which he would submit after having received government instructions. Judge Mandokhail said the Parliament should examine political issues and that the CB is supposed to be limited to the instantaneous case. “They should also make this political decision that the civil system has failed and that all cases should now be sent to the military court,” he said.
AGP Awan said he would present arguments on three points. “The lawyer for the Ministry of Defense, Khawaja Haris, has already given arguments concerning the events of May 9, 2023.
The court postponed the hearing of the case until May 5.
