The tug between the newly transferred judges or appointed to the high court of the capital and its former guards continues as a division bench – led by judge Mohin Akhtar Kayani – ordered a case before a bench which heard it earlier. However, following this ordinance, the ISLAMABAD High Court Registrar Office (IHC) has published a new case list on the investigation of the acting chief of the judge, Sardar Muhammad Sarfraz Dogar, without any case listed in the toothache to come before Kayani. A division bench including judge Kayani, also the judge then superior of the IHC, and judge Sardar Ejaz Ishaq Khan held an appeal against the order of a court of responsibility in a case linked to a diversion of land in the Islamabad E-11 sector. During the last hearing of the case – April 28 – the question was postponed until May 22 due to the unavailability of the bench. However, the IHC registrar also published a new list of rights on April 28 on the investigation of the chief theater, according to which the case was registered for hearing before a new bench, including judge Kayani and judge Saman Rafat Imtiaz. This new bench heard the case on Friday. According to a written order made after the hearing, the bench was informed that the case had already been partly heard by a bench composed of judge Kayani and judge Khan. The bench, therefore, ordered the revision of the case to the original bench. Following the ordinance, a list of rights of new judges was published. In the new list, the division bench led by judge Kayani has been dissolved and is no longer included in next week’s list. One day earlier, during the hearing of an outrageous case, judge Sardar Ejaz Ishaq Khan had noted that he could not claim that there was no conflict between the judges of brother at the high court of the capital.
"There is a conflict between judges. Why should I claim the opposite? Gloves are turned off," He said. The Ministry of Law, on February 1, published a notification for the transfer of judge Sardar Muhammad Sarfraz Dogar, judge Khadim Hussain Soomro and judge Muhammad Asif – respectively from the High Court of Lahore, the High Court of Sindh and the High Court of Balochistan – at the IHC.
