Elahi’s arrest warrants have canceled

Rawalpindi:

A Rawalpindi court of responsibility canceled the arrest warrants issued for the former Punjab chief minister, Chaudhry Pervaiz Elahi on Wednesday, while reserving his decision at his request for exemption from personal appearances.

Elahi has also officially challenged the legal validity of the National Liver Bureau’s reference (NAB) filed against him.

The court accepted the petition contesting the reference to hear and ordered the NAB to submit a detailed response. The case of the case was adjourned until July 17.

In the petition contesting the reference, the Elahi legal team argued that the document does not sign the president of the president of the NAB or that it was not dated. Lawyers have asked that the reference be completely rejected rather than judging trial.

Elahi appeared before the court in person at the hearing of the reference involving 26 co-accused, linked to the alleged illegal attribution of government forest land in Takht Pari.

The legal team representing Elahi, defends Qazi Misbah and Sardar Abdul Razzaq, finished his arguments on his appearance of appearance.

Discussing the admissibility of the reference, the lawyer Qazi Misbah said that the document was missing both the signing of the president of the NAB and a date, which made him legally untenable and unacceptable.

However, the prosecutor of the NAB, Sardar Muzaffar, challenged the complaint, arguing that the signature was indeed present. In response, the defense lawyer demanded that the signature be shown, maintaining that no signature or date exists on the document.

Defense also cited legal precedents supporting the request for exemption and submitted medical reports, saying that because of the deterioration of Elahi’s health, it was not possible for him to appear at each hearing. The reports indicate that Elahi has undergone broken ribs and can only sit with physical support during legal proceedings.

The lawyer also argued that by virtue of the Supreme Court directives, a declaration of an accused could be registered via a video link.

When asked by the judge to approach the rostrum, Elahi reiterated: “My medical report is before you. Given my condition, I cannot attend each hearing. Please consider my health or give me three weeks.”

The defense argued that the state of Elahi demanded that it be seated with back support and that participation in the Court each time would be extremely difficult.

The accusation, however, has opposed both the request for an exemption and to the argument for a three -week stay, arguing that the accused should appear at the next hearing, after which the court could reconsider his request.

The court ordered Elahi to ensure its appearance at the next hearing, declaring: “You must appear on the next date; we will decide what to do afterwards”.
