Peshawar: The High Court of Peshawar (PHC) prohibited Tuesday the president of the National Assembly and president of the Senate of the appointment of opposition leaders in their respective homes following the denotation of the Pakistani Omar Ayub of the Térrék-E-insaf (PTI) Omar Ayub and Shibli Faraz of higher parliamentary positions.
Hear a petition against the decision of the Pakistan decision commission (ECP) to include Ayub and Faraz, the bench of two PHC members including judge Arshad Ali and judge Khurshid Iqbal also prohibited the electoral body from taking other measures against the politicians of the opposition party.
The court postponed the hearing until August 15.
The development comes after the ECP last week, denoted nine PTI legislators, of which Ayub and Faraz, following their convictions in the affairs of May 9.
The list included Ayub (MNA of Na-18 Haripur), Rai Hassan Nawaz (MNA of NA-143 Sahiwal-III), Zartaj Gul (MNA of NA-185 DG Khan-II), Rai Haider Ali (MNA de Na-185 DG Khan-II) and Sahibzada Hamid Raza (MNA (MNA ( Faisalabad-X) of the lower room of the Parliament.
The members of the Assembly of Punjab Muhammad Ansar Iqbal (MPa of PP-73 Sargodha-III) Junaid AFZAL (MPA of PP-98 Faithbad-L), and Rai Muhammad Murtaza Iqbal (MPa of PP-203 Sahiwal-Vi) were also inodified.
The legislators were disqualified under article 63 (1) h) of the Constitution (one person is disqualified [if] … He was convicted of any offense involving moral turpitude, sentenced to imprisonment for a period of at least two years).
ECP’s decision follows the 10 -year sentence granted to PTI leaders by a special factoric anti -terrorist in Faisalabad (ATC).
In its verdict, the Special ATC condemned 108 individuals from the total of the 185 accused, who also includes the head of the Sunni Ittehad (sic) council, Hamid Raza, who received 10 years of imprisonment.
Addressing the media today, the president of the PTI, lawyer Gohar Ali Khan, said that the PHC had prohibited the ECP from the issue of disqualification and had also prohibited the appointment of opposition leaders in the two chambers of Parliament.
