IHC rejects Bushra Bibi’s request for family reunion

Court rules that health condition of Bushra Bibi, who is in detention, falls within executive domain

ISLAMABAD:

The Islamabad High Court (IHC) has ruled on a petition seeking a court order for family reunions and access to a personal doctor for Bushra Bibi, returning the matter to the Adiala Prison Superintendent with directions to re-adjudicate the application.

Justice Arbab Muhammad Tahir delivered a written judgment on the petition filed by Mubashra Khowar Maneka, the daughter of Bushra Bibi.

In its judgment, the IHC observed that if the Superintendent of Adiala Prison rejects the application, the petitioner can approach the forum of the Inspector General of Prisons. Regarding the provision of articles of daily use to Bushra Bibi, the court noted that the superintendent of Adiala Prison had previously stated that such articles were being provided.

According to the judgment, the superintendent of Adiala Prison maintained that Bushra Bibi’s medical treatment was ongoing and she had also been shifted to a hospital outside the prison as required.

“The question of the medical condition of Bushra Bibi, who is in custody, falls within the executive domain. If there is any objection in this regard, a forum exists under the jail rules,” the court said.

The IHC ordered that copies of the judgment be sent to the Islamabad Commissioner and the Superintendent of Adiala Prison, and disposed of the petition.

The Islamabad High Court (IHC) on Wednesday issued notices to the state on various applications seeking an early hearing on the sentence suspension pleas of lawyers Iman Mazari and Hadi Ali Chatha in the controversial tweets case.

Justice MuhammadAzam Khan heard the pleas and remarked: “We are issuing notices; we will also hear the other side. »

Advocate Faisal Siddiqui, counsel for Imaan Mazari and Hadi Ali Chatha, requested the court to fix the hearing of the case on Monday.
