Trump asks Supreme Court to overturn birthright citizenship verdict

United States President Donald Trump said Wednesday that his legal team would “immediately” ask the Supreme Court to review its own ruling on birthright citizenship. Earlier, the court rejected his decree last month by 6 votes to 3.

Trump criticized the decision and called it a “miscarriage of justice.”

The case challenged Trump’s executive order from his first day back in office, which attempted to deny citizenship to children born in the United States to parents who were undocumented or only temporarily residing in the country.

Chief Justice John Roberts wrote the majority opinion. He said the 14th Amendment clearly states that anyone born on American soil and “subject to the jurisdiction” of the country is a citizen at birth. This includes children of undocumented immigrants and those on temporary visas.

Five other justices supported Roberts’ opinion while three dissented.

If Trump gets the SCOTUS to reconsider the case, it will mark a historic first as the highest court has never reconsidered a case after its decision nor has it granted a rehearing on a case argued in decades.

Court rules require a rehearing of the motion within 25 days of the decision, and only in exceptional circumstances, such as a major legal issue that the justices may have overlooked.

Trump does not seem discouraged. In his post, he highlighted claims that billboards near the southern border and in Mexico advertise “birthright citizenship” services, with prices starting at $4,000.

“This miscarriage of justice will destroy America if it does not change its absolutely senseless decision,” Trump wrote.
