Carnival Cruise Line is facing a major personal injury lawsuit following a passenger’s allegation of severe second-degree burns to his feet.
He was injured while walking barefoot on the Lido deck of the Carnival Magic.
The lawsuit was filed by Florida resident Jorge Luis Alverio Nunez in the Southern District of Florida on May 11, 2026, seeking damages in excess of $5 million. This happened over a year ago, on May 21, 2025, while the ship was passing through the Caribbean.
Court documents revealed that Nunez took two steps from the pool to a nearby lounge chair where his shoes were.
He said the deck surface was too hot for guests to walk barefoot as the temperature exceeded 30°C (86°F) due to the strong Caribbean sun, causing burns that had to be medically treated.
These injuries are now causing him mobility issues and physical disfigurement.
Nunez says Carnival Cruise Lines is at fault due to its negligence regarding its failure to ensure safety on deck by providing cooling measures or warning guests with appropriate signage.
Additionally, the complaint states that guests were not informed about wearing shoes.
Because Carnival generally recommends wearing sandals or water shoes for protection, the plaintiff says this proves the company was aware of the risk.
The cruise line has remained silent regarding pending legal action.
The dispute also refers to previous grievances made by passengers on social media regarding hot decks, highlighting one case where a below-the-knee amputation allegedly took place. The Carnival Magic ship continues its Caribbean cruises from Miami.
