He said appeals courts have a duty to decide disputes themselves when the file is complete.

ISLAMABAD:

The SC held that the power to remand cases to lower courts for rehearing is an exceptional and remedial power which cannot be exercised routinely.

He said appeals courts have a duty to decide disputes themselves when the case is complete, rather than subjecting litigants to protracted litigation.

According to a detailed judgment, a two-member bench comprising CJP Yahya Afridi and Justice Shahid Bilal Hassan converted a petition filed by Muhammad Zubair into an appeal and allowed it in a family dispute involving khula, dowry, gold jewelry and maintenance of children.
